General Terms

These Terms and Conditions govern access to and use of the BMUP platform, operated by BMUP — Imobiliário Lda. By creating an account or using the platform, the user declares that they have read, understood and accept these Terms and our Privacy Policy.

1. Purpose

BMUP is a private platform that connects members interested in sale and investment opportunities, particularly in the real estate and business markets. BMUP provides the space and the tools for contact between members; it is not a party to the deals concluded between them and charges no commission on those deals.

2. Membership and account

• Membership is subject to application and to approval by BMUP, which may refuse it without having to give reasons.
• The member undertakes to provide true and up-to-date information and is responsible for keeping their sign-in credentials confidential.
• The account is personal and non-transferable.

3. Membership plans

Access to the features of the member area depends on the membership plan taken out, under the conditions and at the prices set out on the Membership Plans page. Each plan defines, among other things, the number of listings the member may publish and the value of the deals they can access. Once the plan period ends without renewal, access to the member area is limited and listings are no longer visible to other members.

4. Listings and buyer requests

• The member is solely responsible for the content they publish — texts, prices, photos and documents — and warrants that it is true, that they are entitled to disclose it and that it does not infringe third-party rights or the law.
• Listings and buyer requests are reviewed by BMUP before becoming visible. BMUP may refuse, suspend or remove any content it considers inappropriate, misleading or contrary to these Terms.
• The approval of a listing does not constitute verification or a guarantee by BMUP of the asset, the deal or the information it contains.

5. Contact between members

Messages exchanged on the platform are intended exclusively for negotiating the published opportunities. Each member is responsible for carrying out whatever checks they consider necessary (due diligence) before any deal. Using the platform to send unsolicited advertising, for abusive contact or for unlawful purposes is prohibited.

6. Confidentiality

The opportunities published in the member area are confidential. The member undertakes not to disclose to third parties, without the permission of whoever published them, the information they access through the platform.

Liability and Final Provisions

7. Intellectual property

The BMUP brand, the design and the content of the platform belong to BMUP or its licensors. The member grants BMUP the right to display on the platform the content they publish, for as long as it is active.

8. Limitation of liability

BMUP strives to keep the platform available and secure but does not guarantee that it will operate without interruptions or errors. BMUP is not responsible for the deals concluded between members, for the accuracy of the information they publish, or for losses resulting from the use of the platform, except where the law does not allow such exclusion.

9. Suspension and cancellation

BMUP may suspend or cancel the account of a member who breaches these Terms. The member may cancel their account at any time by contacting us.

10. Personal data

The processing of members' personal data is governed by the Privacy Policy.

11. Changes

BMUP may change these Terms. Relevant changes will be communicated to members and apply from the date of publication.

12. Applicable law and disputes

These Terms are governed by Portuguese law. In the event of a consumer dispute, the consumer may turn to the alternative dispute resolution bodies listed in the Privacy Policy and to the Electronic Complaints Book.
